NCLAT to decide Meta’s plea against CCI’s Rs 213.14 cr penalty on Jan 23

Senior advocates Kapil Sibal and Mukul Rohatgi appeared for the court appearing, and during its course, they contended that the CCI had overstepped its jurisdiction by ruling on WhatsApp’s privacy policy.

Meta faces major regulatory setback in India over WhatsApp data-sharing

The state commission, presided over by President Sushil Kumar and Member Sudha Upadhyay, stated that "WhatsApp is a service provider company" and its provision of services within India means it "cannot be said that this company is a foreign company and the consumer complaint against it is not maintainable." The ruling directly contradicts the district commission's view that WhatsApp users are not consumers of the platform.

The Competition Commission of India has imposed a $24.5 million fine and a five-year ban on data-sharing, forcing Meta to rethink its operations in its largest market.
